Terms and Conditions
These Terms and Conditions (“T&C”) set forth the legally binding framework between you (“User,” “You,” or “Your”) and Tourbodies for:
– Accessing/using Tourbodies’ website(s), mobile applications, or other sales channels (collectively, “Platform”).
– Booking any experiences, activities, accommodations, flights, visa assistance, or full tour packages through Tourbodies.
By using the Platform, creating an account, or making any Booking, You acknowledge that you have read, understood, and agreed to these T&C. If You do not agree, please discontinue use of the Platform immediately.
1. Definitions
The following definitions apply throughout these T&C:
User, You, Your: Any person or entity visiting, accessing, registering on, or making a Booking through the Platform.
Booking: Any confirmed purchase or reservation for a single activity/experience or a complete tour package (comprising hotels, flights, visas, transfers, etc.).
Supplier or Third-Party Supplier: The entity actually providing the service, such as a hotel, airline, local activity operator, visa agency, or transport provider.
Services: All offerings booked through Tourbodies, including but not limited to tours, hotels, flights, experiences, activities, visas, and associated logistics.
Quotation: A formal offer from Tourbodies containing the service details (inclusions/exclusions), schedule, price, cancellation terms, and payment deadlines. Once the User pays in full, the Quotation and these T&C become the final contract, overriding any conflicting verbal, email, WhatsApp text, website statements, or other forms of communication.
Platform: Tourbodies’ websites, apps, partner pages, social media accounts, and any affiliated channels or methods used for promotion, booking, or customer support.
User Content: Any text, images, reviews, feedback, videos, or other materials posted by the User on or through the Platform.
Force Majeure: Events or circumstances beyond Tourbodies’ control, including but not limited to natural disasters, pandemics, strikes, political unrest, etc., which prevent or delay the delivery of Services.
2. Application & Scope: Part A and Part B
To address all booking types, these T&C are split into two parts:
Part A – Direct Experience/Activity Bookings
Covers scenarios where you book only a single experience or activity (e.g., a jungle trek, a museum ticket, a guided city tour) via the Platform.
Part B – Complete Tour Packages
Covers scenarios where You book a multi-service package (e.g., flights, hotels, multiple experiences, visa facilitation, transfers) as a bundled itinerary.
General policies apply to both unless otherwise specified.
3. Legal Agreement & Booking Contract
Legal Standing
By using Tourbodies, you confirm you are at least 18 years old and have the authority to enter a binding contract.
Final Quotation is the Binding Contract
For Part B bookings, the final Quotation becomes legally binding once payment is made.
For Part A bookings, the booking confirmation voucher and these T&C form the contract.
Role of Tourbodies
Tourbodies acts as an aggregator or facilitator; actual Services are provided by independent Suppliers.
Part A: Direct Experience / Activity Bookings
A1. Booking Process
You select the activity, date, and participants. After payment, you receive confirmation.
A2. Supplier’s Right to Deny Service
Suppliers may deny participation if eligibility criteria are not met. No refunds apply.
A3. Cancellation & Refunds
Supplier terms govern cancellations and refunds.
A4. User Responsibilities
Users must review details, provide accurate information, and comply with local rules.
A5. Assumption of Risk
Users acknowledge inherent risks in certain activities.
Part B: Full Tour Packages
B1. Role & Responsibility of Tourbodies
Tourbodies acts as facilitator and does not operate airlines, hotels, or transport services.
Final Quotation terms become binding once payment is made.
B2. Booking Conditions & User Obligations
Users must provide accurate details, follow payment schedules, and comply with local regulations.
Tourbodies does not accept cash deposits.
Confirmations depend on payment and supplier availability.
B3. Flights Policy
Airline rules apply. Tourbodies facilitates ticket purchase but is not liable for airline operational decisions, delays, or cancellations.
B4. Hotel & Accommodation Policy
Tourbodies does not own or manage hotels.
Hotel policies, local taxes, deposits, and charges are governed by the property.
B5. Visa Policy
Tourbodies provides visa facilitation only.
Visa approval is solely at embassy discretion.
Visa fees are non-refundable unless stated otherwise.
B6. Transfers & Transport
Group and private transfer rules apply.
Tourbodies is not liable for delays due to breakdowns, traffic, or supplier actions.
B7. Cancellations & Modifications (Packages)
Cancellation fees follow the Quotation schedule.
Refunds processed only after supplier refunds are received.
Modification fees apply unless waived under documented emergency conditions.
(All medical emergency, family emergency, compassionate cancellation, and verification rules remain as stated.)
B8. Limitation of Liability
Tourbodies’ liability is limited to the booking amount paid.
Tourbodies is not liable for supplier actions, personal injury, loss, or force majeure events.
General Provisions (Applicable to Both Part A & B)
1. User Conduct & Content
Users must not post unlawful or abusive content.
User content may be used by Tourbodies for operational or marketing purposes.
1.2 Data Collection and Security
Users agree to marketing communication and data sharing with service partners for operational purposes.
Payment processing occurs through third-party gateways.
Tourbodies does not store card details.
1.3 User Consent for Communication
Users provide consent for communication as per TRAI or equivalent regulations.
2. Indemnification
Users indemnify Tourbodies against claims arising from misuse or violation of T&C.
3. Intellectual Property
All platform content belongs to Tourbodies or its licensors.
4. Governing Law & Dispute Resolution
Karnataka jurisdiction applies.
Courts in Bengaluru have exclusive jurisdiction.
5. Severability & Waiver
Invalid provisions do not affect remaining terms.
6. Entire Agreement & Revisions
These T&C and final booking documents form the complete agreement.
Tourbodies may revise terms at any time.
